Tax-Efficient Retirement and Estate Planning for Hampton Roads Families
Tax mitigation is the process of legally reducing the taxes you and your heirs pay over your lifetime and beyond. For most retirees, the biggest opportunities are not in a single year’s return. They come from planning when and how you draw income, which accounts you use and how your assets will pass to your children. Legacy Solutions Estate & Income Planning helps families across Virginia Beach and Hampton Roads build a long-term tax strategy and coordinates it with your CPA.
Taxes are often one of the largest expenses in retirement, and much of the tax bill can be managed with planning.
The order you withdraw from taxable, tax-deferred and Roth accounts affects your lifetime taxes and how much of your Social Security is taxed.
Required minimum distributions, Roth conversions and charitable giving strategies can all change your tax picture.
Most adult children who inherit an IRA must empty it within 10 years, so planning ahead can reduce the tax bill your heirs face.
Why Retirement Is a Tax Planning Opportunity
Many retirees have most of their savings in traditional IRAs, 401(k)s or the Thrift Savings Plan, where every dollar withdrawn is taxable income. Required minimum distributions can push income into higher brackets, and up to 85% of Social Security benefits can become taxable when other income rises.
The years between retirement and required distributions are often the best window to act. Strategies such as partial Roth conversions, planned withdrawal order and charitable giving from IRAs can smooth taxable income over time and reduce what you and your heirs pay. We coordinate every recommendation with your CPA.

What Are Tax Mitigation Strategies?
During your working years, taxes are mostly withheld from a paycheck and there are few decisions to make. In retirement, you control when income shows up and where it comes from. That control creates opportunities. Pulling the right amount from the right account in the right year can keep you in a lower tax bracket, reduce the tax on your Social Security and avoid higher Medicare premiums.
Tax mitigation also looks past your own lifetime. Traditional IRAs and 401(k)s pass to heirs with a built-in tax bill, while other assets may receive a step-up in cost basis at death. Knowing the difference lets you decide which assets to spend, which to convert and which to leave to family or charity.
Who Benefits From Tax Planning?
Pre-retirees with most of their savings in traditional 401(k)s, IRAs or the Thrift Savings Plan.
Retirees approaching required minimum distributions who want to avoid a jump in taxable income.
Military retirees coordinating taxable retired pay with TSP withdrawals and Social Security.
Couples planning for the higher single-filer tax brackets the surviving spouse may face.
Parents and grandparents who want to leave retirement accounts to children without a large tax bill.
Charitably minded families who want their giving to also reduce taxes.
How Our Tax Planning Process Works
Education first. We explain how retirement income is taxed, including Social Security, pensions, IRA withdrawals and investment income.
Review your tax picture. With your recent tax returns, we look at your bracket, your account types and the income you expect in the coming years.
Project the future. We estimate how required minimum distributions, Social Security and a spouse’s passing could change your taxes over time.
Recommend strategies. These may include a withdrawal order, partial Roth conversions in lower-income years, qualified charitable distributions or beneficiary changes.
Coordinate with your CPA. We share the plan with your tax professional and revisit it each year as tax laws and your income change.
Common Tax Mitigation Strategies
Roth conversions. Moving money from a traditional IRA to a Roth IRA means paying tax now, ideally in lower-income years, so future withdrawals can be tax-free for you and your heirs.
Withdrawal sequencing. Drawing from taxable, tax-deferred and tax-free accounts in a planned order can smooth taxable income from year to year.
Required minimum distribution planning. Required distributions from traditional retirement accounts generally begin at age 73. Planning before then can help avoid a sudden jump into a higher bracket.
Qualified charitable distributions. Once you reach age 70½, you can give directly from an IRA to charity, which can count toward your required distribution without adding to taxable income.
Legacy tax planning. Choosing which assets go to which heirs, and when, can reduce the total tax your family pays. Virginia does not have a state estate or inheritance tax, and the federal estate tax applies only to very large estates, so for most families income tax on inherited retirement accounts is the bigger concern.

Tax Planning for Military Retirees
Military retired pay is taxable at the federal level, and Virginia has phased in a subtraction for military retirement income. Combined with the TSP, a civilian pension and Social Security, the tax picture can change quickly. We help military families coordinate these sources and work with their CPA to make the most of the rules that apply to them.

It depends on your current and future tax brackets, how long until you need the money and whether you plan to leave the account to heirs. Partial conversions spread over several lower-income years are often worth modeling. We run the numbers with you before any decision.
-
Withdrawals from an inherited traditional IRA are generally taxed as ordinary income to the beneficiary. Most adult children must empty the account within 10 years, which can push them into higher brackets during their peak earning years. Planning ahead can soften that impact.
-
No. Virginia repealed its estate tax, and it does not have an inheritance tax. The federal estate tax applies only to estates above a very high exemption amount. For most families, income taxes on inherited retirement accounts matter more. Learn more about our estate planning services.
